MOCRA and CBD Regulations
President Joe Biden signed a massive 1,600-page bill into law at the end of December 2022. This bill was the “Modernization of Cosmetics Regulation Act of 2022,” otherwise known as “MOCRA.” The bill is significant to the regulation of many sectors, including the cannabis cosmetics market.
CBD currently has no regulation for consumable products. In fact, as of January 31, the FDA has once again postponed regulating dietary CBD products by recommending Congress come up with a regulatory plan.
MOCRA is therefore one of the only CBD regulatory laws in existence.
Pre-MOCRA, cosmetic companies didn’t have to test or report about the safety of their ingredients. The FDA also had no authority to recall a product, even if it was dangerous.
Now, cosmetic companies with hemp-derived CBD or other cannabinoids must comply with MOCRA requirements for:
- registration and product listing
- good manufacturing practices
- records
- recalls
- adverse event reporting
- safety substantiation
This is a positive step in the right direction for CBD regulation. It’s shocking that it’s taken this long to regulate the ingredients in cosmetic products, even if they are deemed dangerous. Now that regulations are in place for cosmetics, the chances are greater that more regulations will pass to help guide CBD manufacturers in safety and quality standards.
