Georgia to Be First State to Provide Medical Marijuana in Independent Pharmacies

Georgia is making history–it will soon be the first state in the nation to provide medical marijuana in independent pharmacies. Medical marijuana will not be available in chain pharmacies like CVS or Walgreens.

Instead, the Georgia Board of Pharmacy is reviewing applications of independent pharmacies. So far, nearly 120 pharmacies have been approved to supply low-grade THC oil from Botanical Sciences.

Low-grade THC oil contains no more than 5% THC, which is the compound that gives users the infamous euphoric high.

There are strict policies about who can purchase medical marijuana. Only Georgian residents are approved, and they must have a severe illness such as:

  • seizures
  • terminal cancers
  • Parkinson’s disease
  • post-traumatic stress disorder.

Georgians must have a state-issued low THC oil registry card and identification in order to purchase medical marijuana.

Wisconsin Passes Law for Tougher Penalties for Reckless Drug-Related Homicides

Last week, Governor Tony Evers signed the 2023 Wisconsin Act 29, which increases the penalty for those involved with drug-related homicides. The law moved drug-related homicide from a Class C felony to a Class B felony.

Previously, Wisconsinites guilty of these charges would receive a fine of up to $100,000, up to 40 years in prison, or both. Under the new law, the guilty party would receive up to 60 years in prison.

Representative Allen gave a chilling statement about the new law: “I say woe to the merchants of death, woe to those who are dealing drugs, because we’re coming after you, and we’re going to put you behind bars and keep you off the streets.”

Lawmakers hope the new felony charges will help deter drug dealers, but they know that treatment and prevention protocols are also needed.

The law was put into motion after a college freshman died after taking what he thought was Percocet but was 100% fentanyl.

“Far too many Wisconsinites have lost their lives or loved ones to opioids and other harmful substances, and we must do everything we can to stop these tragedies and invest in efforts to treat substance use across our state,” Governor Evers said in a statement about the new law.

At the beginning of the pandemic, the Drug Enforcement Administration (DEA), which regulates medications with potential for abuse, allowed controlled substances like Adderall and Xanax to be prescribed by a physician through telehealth services. The DEA was supposed to let this provision lapse, but the agency has allowed these provisions to continue through the end of 2024.

It remains undecided if these telehealth allowances will be a permanent means of prescribing drugs or if the DEA will recommend phasing it out in the future.

President Joe Biden signed a massive 1,600-page bill into law at the end of December 2022. This bill was the “Modernization of Cosmetics Regulation Act of 2022,” otherwise known as “MOCRA.” The bill is significant to the regulation of many sectors, including the cannabis cosmetics market.

CBD currently has no regulation for consumable products. In fact, as of January 31, the FDA has once again postponed regulating dietary CBD products by recommending Congress come up with a regulatory plan.

MOCRA is therefore one of the only CBD regulatory laws in existence.

Pre-MOCRA, cosmetic companies didn’t have to test or report about the safety of their ingredients. The FDA also had no authority to recall a product, even if it was dangerous.

As of January 31, British Columbia has decriminalized hard drugs including:

  • Cocaine
  • Heroin
  • Fentanyl
  • Methamphetamine 
  • Morphine

Individuals over the age of 18 are allowed to legally carry up to 2.5 grams of each substance; they will not be arrested, charged, or have the drugs confiscated. Carrying over 2.5 grams would result in arrest and confiscation of the drugs.

This plan is permitted for the next three years.

“Decriminalizing people who use drugs breaks down the fear and shame associated with substance use and ensures they feel safer reaching out for life-saving supports,” said Jennifer Whiteside, the British Columbia minister for mental health and addictions.

The hope is that decriminalizing the drugs will result in fewer overdose deaths. However, many critics claim that 2.5 grams is too low of a threshold to make a difference. Their argument is to provide more funding and opportunities to address the real reason the individual began drugs in the first place–otherwise, it’s condemning them to a slow death on drugs.

A similar drug decriminalization plan was enacted in Oregon a few years ago and has failed so far.

The Food and Drug Association announced on January 26 that it would not establish guidelines on CBD as a dietary supplement.

However, the FDA’s suggestion is for Congress to create a new law or agency that allows regulation of safety concerns that allow individuals to access CBD products.

“We have been waiting for four years for FDA to promulgate rules surrounding the use of CBD in dietary supplements and foods, but instead, what we heard from FDA is that it doesn’t have the ability under current frameworks to analyze the health impacts of CBD and therefore punted back to Congress to devise new legislation, a scheme or a regulatory framework for FDA to oversee the products,” lawyer Cori Annapolen Goldberg said.

Postponing a new regulatory structure could backfire for the FDA and Congress, as CBD popularity has gained significant momentum. CBD’s U.S. market size is projected to reach $1.9 billion in 2023 and $3 billion by 2027, according to a report by CannIntelligence.

  • 500 doses of substances suspected to contain synthetic cannabinoids;
  • 1,000 units of homemade edibles suspected to contain synthetic cannabinoids;
  • Approximately $2 million in cash”
